1) Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of the ErinWave Aviation website located at ErinWave.cyou (the "Site") and any related content, guides, articles, and workshop enquiry features (collectively, the "Services"). The Services are operated by ErinWave Aviation Learning Ltd ("ErinWave Aviation", "we", "us", or "our").
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
You must be at least 16 years old to use the Services. If you are under 18, you confirm that you have permission from a parent or legal guardian to use the Services and that they have reviewed these Terms with you.
2) Educational Scope and Disclaimer
ErinWave Aviation provides educational and hobby-focused content about civilian aviation, aircraft design, flight principles, aviation history, and related culture. The Services are intended for general information and learning, not for operational decision-making.
- The Services are not flight training and are not a substitute for instruction from certified aviation educators or approved training organisations.
- The Services do not provide licensing, certification, regulatory sign-off, or guarantees of competence for piloting or aircraft operation.
- Aviation involves risk. If you require operational guidance, consult official aviation publications, manufacturer documentation, qualified instructors, or relevant aviation authorities.
While we aim for practical accuracy, aviation concepts can be context-dependent. A statement that is correct in a simple fixed-wing training scenario may not generalise to all aircraft categories, configurations, weather, or operational constraints.
3) Description of the Services
The Services may include, depending on availability: written guides and explainers, educational articles, curated reading routes, diagrams or visual references, workshop descriptions, and a contact form for questions and session enquiries. We may update, improve, remove, or reorganise portions of the Services at any time.
Any examples, simplified models, or conceptual explanations are provided to build understanding. For instance, aerodynamic discussions may describe angle of attack, boundary layer behaviour, and stability in plain language. These discussions are not aircraft-specific operating instructions and should not be treated as such.
4) Workshop Enquiries and Communications
If you contact us through a form or by email, you agree to provide accurate information and not to submit unlawful content. We use enquiry information to respond, propose learning routes, and, where relevant, coordinate workshop session options. We do not promise that any specific workshop date, format, or availability will be offered.
You are responsible for ensuring that any message you send does not include sensitive information you do not wish to share. Our Privacy Policy explains how we process personal data and the rights available to you under applicable law.
5) Acceptable Use
You agree to use the Services in a respectful and lawful manner. You must not:
- Attempt to gain unauthorised access to the Site, servers, or systems, or bypass security measures.
- Introduce malware, spam, or harmful code, or engage in phishing, impersonation, or deceptive behaviour.

Except where permitted by law, you may not copy, reproduce, republish, distribute, or create derivative works from the Services without our prior written consent. Short quotations for commentary, classroom discussion, or fair dealing/fair use may be permitted where the law allows, provided you attribute the source appropriately.

8) Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content is complete, current, or free from inaccuracies. Aviation knowledge is broad and evolves; a lesson may be updated as terminology changes or as we refine explanations.
9) Limitation of Liability
To the maximum extent permitted by applicable law, ErinWave Aviation Learning Ltd and its directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or related to your use of the Services.
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid to us for the Services in the 12 months before the event giving rise to the claim, or (b) EUR 100.
Nothing in these Terms limits liability that cannot be limited under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, where applicable.
10) Indemnification
You agree to indemnify and hold harmless ErinWave Aviation Learning Ltd from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your misuse of the Services, (b) your violation of these Terms, or (c) your infringement of any rights of another person or entity.
11) Force Majeure
We will not be liable for any delay or failure to perform resulting from events beyond our reasonable control, including natural disasters, acts of government, war, civil unrest, labour disputes, internet outages, cyberattacks, or third-party hosting or infrastructure failures.
12) International Use and Availability
The Services are operated from Ireland. We make no representation that the Services are appropriate or available for use in all locations. You are responsible for compliance with local laws and regulations applicable to your access and use of the Services.
13) Governing Law and Dispute Resolution
These Terms are governed by the laws of Ireland, without regard to conflict of law principles. The courts of Dublin, Ireland will have jurisdiction over disputes arising out of or relating to these Terms or the Services, subject to any mandatory consumer protection rights that apply to you.

14) Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or if continued access could create risk for the Services or others. Upon termination, the sections that by their nature should survive will remain in effect, including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law.
15) Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
16) Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ErinWave Aviation Learning Ltd regarding the Services and supersede any prior or contemporaneous understandings.
17) Assignment
We may assign or transfer these Terms, in whole or in part, to an affiliate or successor in connection with a business reorganisation, merger, acquisition, or asset sale. You may not assign these Terms without our prior written consent.
18) No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorised representative of ErinWave Aviation Learning Ltd.
19) Modifications to These Terms
We may update these Terms from time to time. Changes will be effective 14 days after they are posted on this page, unless a change is required by law or is necessary for security reasons, in which case it may take effect immediately. The "Last Updated" date at the top indicates when this page was last revised.
20) Electronic Communications
By using the Services or contacting us electronically, you consent to receive communications from us electronically. You agree that electronic communications, including notices and disclosures, satisfy legal requirements that such communications be in writing.
